As if there weren’t already enough reasons to make sure workers are paid accurately, here’s another: Penalties are rising for violations of the Fair Labor Standards Act (FLSA)

 

Repeated or willful violations of FLSA will now cost companies $1964, compared to $1,925 in 2017.

 

Important details

 

The new penalty amount applies to any violations occurring after Nov. 2, 2015, and the Dept. of Labor (DOL) has some leeway in deciding exactly what’s considered a violation. Penalties for repeat violations can be assessed even if companies are fined for different reasons each time (e.g., one overtime violation and one minimum wage violation).

 

With willful violations, employers must know they’re in violation and act in “reckless disregard” of the law, which the DIK can interpret loosely.

 

In light of this, make sure your payroll records are complete, and continue to remind managers about the importance of ensuring employees are accurately recording all time worked.
