Employer falsified timecards, then disposed of them

 

Investigators found glaring paycheck errors at a food-processing plant in Westbury, NY, the state attorney general announced.

 

From 2013 to 2017, Diversified Processors Inc. and Processors Inc. mishandled minimum wage and overtime payments due to 10 plant workers.

 

Now, the employer must pay $120,555 in restitution and additional penalties.

 

Didn’t retain timecards

 

The company informed workers they’d be paid for their first 40 hours of work each week. Problem was, they often worked 60 or more hours.

 

Employees punched in and out, but the company deliberately falsified their hours worked – and didn’t keep the timecards on file. Plus, by using several different third-party payroll providers, the company could more easily hide its problems.

 

Investigators also discovered that the company didn’t maintain workers’ comp insurance – which was especially important as people were operating sharp, heavy equipment.

 

Getting procedures in place

 

Some employees have been known to falsify their timecards, and on occasion, supervisors might be tempted to do the same thing.
