The hits keep coming for the Dept. of Labor’s (DOL) overtime rule changes – and that means it’ll stay business as usual in Payroll, at least for few more months.
The Dept. Of Justice has requested to have until May 1, 2017, to both review an appeal of the rule change and give new leadership a chance to consider the issue.
That request has been granted by the Fifth Circuit Court of Appeals.
But that doesn’t necessarily mean the OT rule will get the review the DOL wants.
The district court handling the original case may still decide the DOL overstepped its bounds by introducing the rule change – and that could be the end of it.
Keep an eye on the courts
Now that the appeal’s been delayed, you won’t need to change your OT practices anytime soon.
You will, however, want to continue keeping an eye on the courts, as some organizations are still pushing hard for the rule to stick.
